Terms of Use

These Terms of Use ("Terms") form a legal agreement between you and Benno TV ("Benno TV", "we", "us", or "our") concerning your use of the Benno TV application, website, account services, device activation services, and related features (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be legally capable of entering into these Terms under the laws applicable to you. Where local law requires parental or guardian authorization, you may use the Service only with that authorization. You are responsible for providing accurate account information, maintaining the confidentiality of your credentials, and for activity under your account.

2. Your content and sources

Benno TV may allow you to add sources such as M3U playlists, Xtream Codes-compatible sources, MAC Portal sources, and local media. You are solely responsible for every source, playlist, credential, URL, file, stream, or item of content you add, access, organize, or play through the Service.

By using Benno TV, you represent that you own the relevant content or have all permissions, licenses, subscriptions, and other rights required to access and use it. You must comply with applicable local, national, and international laws and must not use Benno TV to infringe copyright or other rights, circumvent lawful access controls, or access, download, retransmit, or distribute content without authorization.

3. No endorsement or affiliation

Benno TV does not control or endorse third-party content or content providers merely because their technical format can be used with the app. Compatibility with a playlist, portal, API, service, device, or content source does not imply affiliation, sponsorship, approval, or partnership.

4. License to use Benno TV

Subject to these Terms and any applicable plan or device limits, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use Benno TV on devices you own or control. You may not resell, sublicense, redistribute, copy, rent, commercially exploit, modify, reverse-engineer, decompile, bypass licensing or activation controls, or attempt to extract source code except to the extent such restriction is prohibited by mandatory law.

5. Trials, purchases, subscriptions and device activation

Benno TV may offer free trials, one-time purchases, subscriptions, or other paid plans. The available plan, price, billing period, renewal terms, trial duration, device allowance, and included features will be shown before purchase. Paid access unlocks Benno TV features only and never includes third-party media content.

Subscriptions renew automatically when stated at checkout, unless cancelled before the applicable renewal. Cancellation prevents future renewal charges but normally does not end access already paid for before the end of the current billing period. Trial eligibility may be limited by account, device, payment method, or prior use where permitted by law.

6. Payments through Paddle

For purchases processed through our website, our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for those orders and handles payment processing, applicable sales taxes, billing administration, buyer support for transactions, cancellations, withdrawals, and refunds in accordance with Paddle's buyer terms, refund policy, and applicable law. Benno TV does not receive your full payment-card details from Paddle.

If Benno TV is later distributed through an app store or another authorized sales channel, purchases through that channel may also be subject to that channel's billing and refund terms.

7. Refunds, cancellation and mandatory consumer rights

Refund and withdrawal eligibility for Paddle transactions is governed by Paddle's applicable buyer terms and refund policy together with any mandatory consumer rights in your country. Nothing in these Terms limits rights that cannot lawfully be waived. Where a refund is approved for a Paddle transaction, it is processed through Paddle rather than paid directly by Benno TV.

8. Service changes and availability

We may improve, modify, add, remove, or discontinue features where reasonably necessary, including for security, legal compliance, compatibility, technical maintenance, or product development. We do not guarantee that every feature, content source, codec, portal, device, operating-system version, network, or third-party service will remain compatible.

9. Prohibited use

You may not misuse the Service, interfere with its security or operation, attempt unauthorized access to our systems or other users' accounts, abuse trials or licensing, use automated means to overload the Service, distribute malware, or use Benno TV in connection with unlawful activity.

10. Intellectual property

Benno TV, its software, branding, interface, original graphics, documentation, and related materials are protected by intellectual-property laws. These Terms do not transfer ownership of Benno TV or our intellectual property to you. Third-party trademarks and content remain the property of their respective owners.

11. Copyright and rights-holder notices

Benno TV does not provide or host user media streams as a content service. If you believe that material controlled by Benno TV itself infringes your intellectual-property rights, contact support@bennotv.com with sufficient information to identify the material and your rights. Complaints concerning content supplied by a third-party source should generally be directed to the party hosting or supplying that content.

12. No warranty

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation, compatibility with every device or third-party source, or that the Service will meet every requirement. Nothing in this section excludes warranties or consumer protections that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by applicable law, Benno TV is not liable for indirect, incidental, special, consequential, or similar losses arising from your use of the Service or from third-party content or services. We are not responsible for the legality, availability, accuracy, security, or quality of sources you add. Nothing in these Terms excludes or limits liability where doing so would be unlawful.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Benno TV harmless from third-party claims, losses, and reasonable costs arising from content or sources you add, your infringement of third-party rights, or your unlawful use of the Service. This section does not limit mandatory consumer rights.

15. Suspension and termination

You may stop using Benno TV at any time. We may suspend or terminate access where reasonably necessary because of a material breach of these Terms, fraud, abuse, security risk, legal requirement, or misuse of licensing or activation systems. Where appropriate and legally required, we will provide notice or an opportunity to remedy the breach.

16. Privacy

Our Privacy Policy explains how personal data is collected and processed in connection with Benno TV.

17. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security requirements, or business practices. For material changes, we will provide reasonable notice where required, for example through the app, website, or account email. The effective date will be shown at the top of this page.

18. Governing rules and local rights

These Terms are intended for global use. Mandatory laws and consumer protections that apply in your country of residence remain unaffected. Any choice-of-law or dispute provision published for Benno TV will not deprive consumers of protections that cannot be waived under applicable law.

19. Severability and survival

If any provision is held invalid or unenforceable, the remaining provisions continue in effect. Provisions that by their nature should survive termination, including intellectual property, responsibility for content, liability limitations, and indemnification, continue to apply to the extent permitted by law.

20. Language

These Terms may be made available in multiple languages for convenience. To the extent permitted by applicable law, the English version is the controlling version if translations differ.
